Mr. Komie argued that a prosecutor operating what was effectively his own police force was a clear violation of separation of powers. The Illinois Supreme Court ruled 5-2 in Mr. Komie's favor, finding that Mr. Towne and other prosecutors who create their own police squads in the name of investigation clearly overstep their authority.
